Police report from 1986 says Sylvester Stallone forced teen to perform oral sex on his friend

The teen didn't want to press charges against Sylvester Stallone.

A Las Vegas Metropolitan Police Department report filed by a 16-year-old in 1986 says that Sylvester Stallone, then 40, and his bodyguard at the time, Michael De Luca, then 27, sexually assaulted her.

The report was obtained and published by the Daily Mail on Thursday, but was first obtained and reported on by the Baltimore Post Examiner in February 2016.

According to the report, the 16-year-old, who has not been named, had sex with Stallone, now 71, but was pressured to have sex with Stallone and De Luca at the same time. The teenager told police she was forced to perform oral sex on De Luca before he penetrated her vaginally, then was forced to perform oral sex on Stallone.

The men threatened the teen that “they would have to beat her head in” if she said anything, because both men were married at the time. John Samolovitch, a retired detective sergeant who was head of the sexual assault unit at the time, confirmed with Daily Mail that the obtained police report is a  “true copy” of the original report.

According to the report, police were alerted to the former Las Vegas Hilton when an employee called to report that the teen’s friend said she needed advice about the assault. In recounting the assault, the teen said she was staying at the hotel from July 18 to July 28 with a family friend, during which Stallone was filming at the facility. She said she and her cousin had met actor David Mendenhall at the hotel’s arcade, who then introduced them to Stallone.

Over the course of her stay, the teen said she had seen Stallone twice more. The first time, Stallone asked her her age, as well as “how she got such a build.” She also asked him to kiss her on the cheek after one of her friends received a kiss, to which Stallone reportedly told her he’d, “give her a kiss at a later date, that she would not forget.”

The second time, she met De Luca, who asked her what she’d do it Stallone made a pass at the teen, to which she said she’d make a pass back. That’s when De Luca gave her keys to a room in the hotel, and told her to meet them there. When the teen was having sex with Stallone, she said De Luca came out of the restroom and pressured her for a blowjob after Stallone asked her if she had ever had sex with two men at once. The report says the teen didn’t want to have sex with De Luca, but felt she had no choice.

“During the interview [the teen] became emotionally upset numerous times, crying and sobbing,” police wrote in the report. “She indicated that if the sexual encounter had only been with Stallone, she would not pursue this matter, but due to the fact that Mike, the bodyguard became involved in the sexual incident, she didn’t know what she wanted to do…She states there was no actual physical force, but she did feel intimidated.”

“I’m humiliated and ashamed, but I don’t want to prosecute,” the teen said, according to the report. “I’m kind of scared and I’m very ashamed. I don’t want anybody else to have that happen to them, but I don’t want to prosecute. I cannot talk about this anymore, please leave me alone.”

The teen later signed a no prosecution form and the case was dropped, but police confiscated De Luca’s concealed weapon permit on July 30, 1986. De Luca was shot and killed by California police during a traffic stop in 2013.

A representation for Stallone told Fox News that “This is a ridiculous, categorically false story. No one was ever aware of this story until it was published today, including Mr. Stallone. At no time was Mr. Stallone ever contacted by authorities or anyone else regarding this matter.”
