‘Grand Theft Auto’ player says he heard another gamer rape a teen over headset

The suspect was out on bail after another alleged rape.

A gamer told police that he overheard another player raping a 15-year-old girl during a PlayStation 4 session of Grand Theft Auto, BuzzFeed News reports.

Daniel Enrique Fabian, 18, was arrested on Nov. 21 for allegedly raping the teen at his home in New Port Richey, Florida, on June 28. He was charged with statutory rape.

According to an arrest affidavit, the witness said that during the game, he heard Fabian say over the headset microphone he was planning to “smash” the girl. According to the Tampa Bay Times, the witness is a 16-year-old from Tarpon Springs.

Per the affidavit, Fabian then stopped playing the game for about 15 minutes but left his microphone on. The witness told police that he heard the victim “moan and groan” and tell Fabian “no.” After the 15 minutes passed, Fabian returned to the video game.

The victim reported the alleged assault to Pasco County Sheriff’s Office. She said she knew Fabian and that she was sitting on his bed when he “put his hand over her mouth, pushed her down onto her back, and stuck his penis in her vagina, according to the affidavit,” BuzzFeed News reports. She also said she told Fabian to stop four times.

A rape kit exam supported the victim’s allegations of assault.

According to BuzzFeed News, when the alleged assault occurred, Fabian was out on bail. He had previously been arrested and charged with a felony count of statutory rape for allegedly raping another 15-year-old girl at his house earlier in June.
